Personal data protection charter for employees and applicantsARTICLE 1 - PURPOSE
LES ETAPES ANDRE TRIGANO, SARL with capital of 700,000 euros, registered in the Paris Trade Register: 420175903 Head office: 15 rue du Faubourg Montmartre - 75009 Paris (hereinafter referred to as "the Company"), in the course of its business, the Company processes personal data to ensure the recruitment of its future employees and the management of its employees.
As part of its efforts to comply with Regulation (EU) 2016/679 of April 27, 2016 known as the General Data Protection Regulation, hereinafter referred to as "the Regulation", the Company has implemented the provisions of this Charter relating to the protection of the personal data of applicants and employees.
As these provisions are subject to change over time, please refer to the most recent version available from the HR Department and subsequently on the INTRANET site.
ARTICLE 2 - COLLECTION AND PROCESSING OF PERSONAL DATA
Candidates :
The personal data collected directly or indirectly from applicants is limited to that which is useful in assessing the applicant's suitability for the position to be filled, in accordance with the Company's legitimate interests and employment law:
- Surname, First name, Date of birth, Nationality, E-mail address, Telephone number, Status, Place of residence, Education, Skills and qualifications, Professional experience, Driving license.
Additional information may be requested, such as the contact details of referees, copies of diploma certificates, etc. The sole purpose of this personal data is to verify the candidate's profile. Applicants may exercise their right to erasure as stipulated in article 5 of this document.
Employees:
Personal data collected directly or indirectly from employees, whatever the nature of their contract, casual, fixed-term contract in its various forms or permanent contract, is limited to the data necessary to ensure :
Remuneration and compulsory social declarations ;
Keeping a single personnel register ;
Personnel administration ;
Work organization ;
Security and access management
Labor relations (data collected for employee representative elections or for the Base de Données Economiques et Sociales);
Career management: training, annual and professional appraisals, mobility... ;
Employer-sponsored social action ;
Communications on the life of the Company.
These data are summarized below.
For the employee: Surname, Gender, Birth name, First name, Date, Common name and Country of birth, Nationality, Marital status, Number of dependents, Postal address, E-mail address, Social security number, Position held, Location and working hours, Salary, Bonuses (if any), Variable pay components, Holiday dates, Sick leave dates, Start date, Trial period, Departure date, Final balance.
- For the employee's dependents wishing to benefit from the social security coverage offered by the Company: Last name, First name, Date of birth, Degree of filiation, Nationality, Date of attachment, Social security number...
By providing us with their personal data, the persons concerned undertake to ensure that such data is accurate, truthful, up-to-date and complete. The Company cannot be held responsible for any errors, omissions or inaccuracies in the information provided.
For any other processing of personal data of its employees, the Company undertakes to offer prior consent to the persons concerned, with the possibility of withdrawing this consent at a later date if they so wish.
ARTICLE 3 - PROTECTION OF PERSONAL DATA
For the various personal data processing operations covered by this Charter, in accordance with the Regulations, the Company :
Limits access to this data to its own employees in charge of processing and to those of its partners duly authorized by it: parent company, sister companies and subcontractors, all domiciled in a member state of the European Union, to social organizations and to any legal authority that may request it. - Undertakes to ensure that this data is hosted in a member state of the European Union;
- Protects this data from unauthorized access, accidental or criminal destruction or alteration by means of appropriate organizational and technical measures.
ARTICLE 4 - RETENTION PERIOD FOR PERSONAL DATA
The Company destroys candidates' and employees' personal data no later than two years after receipt of the candidates' data. Additional information requested for verification of profiles is destroyed or returned to candidates within 8 days of the date on which the position is awarded. The Company has no policy of archiving such data.
Documents relating to employees are kept in accordance with the legal provisions in force. Employees' personal data is kept for five years from the date of their departure.
The Company ensures that its partners themselves have undertaken to comply with the Regulations.
ARTICLE 5 - EXERCISING THE RIGHTS OF THE PERSONS CONCERNED
The provisions below are taken by the Company in order to allow the persons concerned by this Charter, in accordance with the Regulation, to exercise their rights on their personal data (right of access, right of rectification, right to erasure, right to limitation of processing, right to portability, right of opposition).

- indicating his or her first name, surname, postal address, if possible fixed or mobile telephone number, and if possible e-mail address where he or she can be reached, if necessary, particularly in order to clarify his or her request;
- specifying the right or rights that the person concerned is requesting to be applied;
- enclosing a copy of both sides of his or her national identity card or a copy of his or her passport.
The Company, or one of its service providers acting on its behalf, will acknowledge receipt of the request and respond as soon as possible, and in any event within one month of receipt of the request, except in special circumstances provided for in the Regulations, where this period may be extended to two months.
In addition, any person concerned may lodge a complaint with the CNIL, the supervisory authority for France, by the means indicated at https://www.cnil.fr/fr/plaintes.
