VACANCES ANDRE TRIGANO Personal Data Protection Charter for Customers and Related Parties

Article 1 - Purpose

Les Étapes André Trigano, head office: 15 rue du Faubourg Montmartre - 75009 Paris (hereinafter referred to as "the Company"), offers, via its website www.vacances-andretrigano.com (hereinafter referred to as the "Website" or in the singular and plural "Site(s)"), its catalog (hereinafter referred to as "the Catalogue") and by telephone, accommodation and camping pitches for rent in France (hereinafter referred to as the "Campsites").

In the course of its business, the Company collects personal data from prospective customers, holidaymakers (customers of the Company, customers of a tour operator, beneficiaries of a works council, and those accompanying them), who are planning to take part or are taking part in a holiday in accommodation or on a pitch rented from the Company.

In the case of holidaymakers, this data is required to process their reservation, to pay the rental price, to welcome them to the campsite (each holidaymaker must produce a valid form of identification), to pay the deposit, to pay the tourist tax and any services offered by the campsite, to manage their stay and, more generally, to manage the Company's commercial relations and to carry out statistical analyses.

A holidaymaker's refusal to provide any or all of his or her personal data, or failure to provide the aforementioned proof of identity, may prevent the Company from processing the reservation request and/or welcoming the holidaymaker to the campsite.

This personal data is intended solely for use by the internal departments of the Company, which is responsible for processing this data, and may be communicated to its partners and subcontractors and partners duly authorized by the Company, such as the Site host and IT maintenance service providers, the Etapes André Trigano reservation center, the online payment service provider, marketing service providers or any legal authority that may request it. "

In its efforts to comply with Regulation (EU) 2016/679 of April 27, 2016 known as the General Data Protection Regulation, hereinafter referred to as "the Regulation", the Company has implemented the provisions of this Charter relating to the protection of the personal data of the persons concerned.

As these provisions may change over time, please refer to the most recent version available on the Website.

Article 2 - Collection and processing of personal data

The personal data of the persons concerned are data collected by the Company, mainly identification data, data present on the Reservation Form, data for creating a personal account on the Site, as well as data necessary for the operation and security of the Site.

 

This data is communicated directly to the Company, by the persons concerned, in one or more of the following ways:

 

- by browsing the Website;

 

- by completing the Reservation Request Form filled in by the Customer on the Site, which is binding on the Company as soon as this form, or any document replacing it, has been expressly accepted in writing by the Company (hereinafter referred to after acceptance as the "Reservation Form"); and, where applicable, by carrying out an online transaction;

 

- by completing the printed Reservation Request Form, and sending the completed form to the Company by post or e-mail ;

 

- by calling the Company's reservation center;

 

- by calling the campsites by telephone;

 

- by taking part in competitions;

 

- at campsite reception.

 

- on stands at trade fairs

 

The Reservation Request Form on the Website or its printed version, completed by the Customer, is binding on the Company from the moment this form or any document replacing it, has been expressly accepted in writing by the Company, and where applicable by completing an online transaction.

 

Certain personal data may also be communicated to the Company by a third party whose customers or beneficiaries are the persons concerned.

 

By providing us with personal data, the persons concerned or third parties undertake to ensure that such data is accurate, truthful, up-to-date and complete. The Company cannot be held responsible for any errors, omissions or inaccuracies in the information provided.

 

This personal data is processed exclusively by the Company in one or other of the cases of processing authorized below to the persons concerned:

 

- The processing is necessary for the performance of a contract or pre-contractual measures with the Company, or to comply with a legal obligation to which the Company is subject. This is the case for the rental of accommodation or pitches for participants in open-air hotel stays. This concerns the Customer's identification data for sending the contract, its execution, the satisfaction questionnaire at the end of the stay and, where applicable, the Customer's credit card information.

 

- Processing is necessary to safeguard the vital interests of the data subject. This is the case for the safety of the persons concerned during their stay in the event of events affecting the site (weather warnings, etc.). This concerns data such as cell phone numbers and vehicle registration numbers.

 

- Processing is carried out in the legitimate interests of the Company. This is the case for sending customers commercial information on the Company's offers. This concerns in particular the customer's postal address and e-mail address.

For other personal data processing operations, such as certain cookies, the Company will offer the persons concerned the opportunity to give their consent, with the possibility of subsequently withdrawing this consent if they so wish.

Article 3 - Protection of personal data

For the various personal data processing operations covered by this Charter, the Company :

 

- limits access to this data to its own employees in charge of processing and those of its partners: parent company, sister companies and subcontractors, all domiciled in a member state of the European Union, and this data always hosted in a member state of the European Union;

 

- protects such data by all appropriate organizational and technical measures against unauthorized access, accidental or criminal destruction or alteration;

- destroys this data - or anonymizes it for statistical purposes - at the latest at the end of the calendar year, after 3 (three) years of no interaction between the Company and the persons concerned, unless a longer period has been specifically agreed by any means. Payment card data relating to the remote transaction concluded within the framework of the Contract is kept for the time strictly necessary to complete the transaction. It is specified that, in compliance with the provisions of the French Monetary and Financial Code, the payment card number and validity date may be kept for up to 15 months, as evidence, in order to manage any claims made by payment cardholders. In addition, any data used to establish proof of a right or contract, or kept to comply with a legal or regulatory obligation, may be subject to an archiving policy, and kept for this purpose in accordance with the legal provisions in force.

Article 4 - Exercising the rights of data subjects

The provisions below are taken by the Company in order to allow the persons concerned by this Charter, in accordance with the Regulation, to exercise their rights on their personal data (right of access, right of rectification, right to erasure, right to limitation of processing, right to portability, right of opposition).

 

To exercise a request concerning one or other of these rights, the person concerned is invited to contact the Company, which is responsible for the processing operations covered by this Charter:

The Company, or one of its service providers acting on its behalf, will acknowledge receipt of the request and respond as soon as possible, and in any event within one month of receipt of the request, except in special circumstances provided for in the Regulations, where this period may be extended to two months.

In addition, any person concerned may lodge a complaint with the CNIL, the supervisory authority for France, by the means indicated at the URL https://www.cnil.fr/fr/plaintes.
